Terms of Service

Effective Date: March 6, 2026

Important: StormGuard Pro is a software tool to assist with stormwater inspection documentation. It does not constitute legal or compliance advice. You are responsible for ensuring your inspections and reports meet all applicable permit requirements, including COR400000.

1. Acceptance of Terms

By creating an account or using StormGuard Pro (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

StormGuard Pro provides a mobile application and backend platform for conducting and documenting construction stormwater site inspections in connection with the Colorado COR400000 General Permit for Construction Stormwater Discharges. The Service includes photo capture, AI-assisted analysis, report generation, corrective action tracking, and related features.

3. Accounts and Organizations

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • Organization administrators are responsible for all activity by users they add to their organization.
  • You must be at least 18 years old to use the Service.
  • One account per person. You may not share login credentials.

4. Subscription and Payment

  • Subscriptions are billed on a per-project basis as described on the Pricing page.
  • All payments are processed by Stripe. By subscribing, you agree to Stripe's terms of service.
  • Subscriptions renew automatically unless cancelled before the renewal date.
  • No refunds are provided for partial billing periods, except where required by law.
  • We reserve the right to change pricing with 30 days' notice to existing subscribers.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any permit or regulation.
  • Submit false or misleading inspection data.
  • Attempt to reverse engineer, decompile, or extract source code from the Service.
  • Use automated tools to scrape or excessively query the Service.
  • Share your account credentials with others outside your organization.
  • Use the Service to store content that infringes third-party intellectual property rights.

6. Compliance Disclaimer

Important Limitation of Liability

StormGuard Pro is designed to assist with COR400000 inspection documentation. However:

  • We do not guarantee that reports generated by the Service will satisfy all regulatory requirements in all circumstances.
  • AI-generated annotations, BMP detections, and suggested corrective actions are tools to assist qualified inspectors — they do not replace professional judgment.
  • You are solely responsible for the accuracy, completeness, and regulatory compliance of all inspection reports submitted under your permit.
  • StormGuard Pro is not affiliated with, endorsed by, or a representative of CDPHE, the Colorado Water Quality Control Commission, or the EPA.

7. Your Data

  • You retain ownership of all inspection data, photos, and reports you create.
  • You grant us a limited license to store, process, and display your content to provide the Service.
  • We do not sell your inspection data to third parties.
  • Photos submitted for AI analysis are processed by OpenAI and Anthropic under our enterprise agreements and are not used to train AI models.

8. Intellectual Property

The StormGuard Pro name, logo, application, and all underlying technology are owned by StormGuard Pro and protected by applicable intellectual property laws. You may not use our trademarks or branding without written permission.

9. Termination

We may suspend or terminate your access to the Service for violations of these Terms, non-payment, or for any reason with 30 days' notice. You may cancel your account at any time. Upon termination, you have 30 days to export your data before it is deleted.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STORMGUARD PRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO REGULATORY FINES, PERMIT VIOLATIONS, OR COMPLIANCE FAILURES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Douglas County, Colorado.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email at least 14 days before taking effect. Continued use of the Service constitutes acceptance of the updated Terms.
